Company/Studio: Irenity Interiors (“Irenity Interiors,” “we,” “us,” “our”)
By accessing or using the Site, contacting us through the Site, or booking/scheduling time with us through the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.
1) Who these Terms apply to
These Terms apply to all visitors, users, and others who access the Site (“you,” “your”).
2) Eligibility
You must be at least 18 years old (or the age of majority in your state) to use the Site and request services.
3) Changes to these Terms
We may update these Terms from time to time. The “Effective Date” above reflects the latest version. Your continued use of the Site after changes means you accept the updated Terms.
4) What we do (and what the Site is for)
Irenity Interiors provides interior design services, including Residential Interiors, Short-Term Rental Design (e.g., Airbnb/vacation rentals), and Design Consultancy (collectively, the “Design Services”).
The Site is provided for general information, portfolio viewing, lead intake, and contacting us for a quote or consultation.
5) Quotes, discovery calls, and working together
Quotes and discovery calls. We may offer an initial call/quote process as described on the Site. Any estimate, timeline, or “direction” we share before a signed agreement is non-binding and informational only.
Separate agreement required. Unless we expressly agree in writing, the Site and these Terms do not create a client-designer relationship for Design Services. If you hire us, the Design Services will be governed by a separate written proposal/contract and/or statement of work (“Client Agreement”). If there is a conflict between these Terms and a Client Agreement, the Client Agreement controls for the Design Services.
6) Scheduling tools and communications
The Site may include scheduling features and contact forms. You agree to provide accurate and complete information when submitting forms or requesting scheduling.
You agree that we may communicate with you via email or other contact details you provide about your inquiry, project, or next steps.
7) Payments, fees, and taxes (if applicable)
If you purchase Design Services or paid consultations, pricing, payment schedules, and refund/cancellation rules (if any) will be defined in the Client Agreement or checkout/invoice terms presented to you at the time of purchase.
You are responsible for any applicable taxes unless we state otherwise.
8) Cancellations and rescheduling (consultations)
If you book a paid consultation (if offered), any cancellation/rescheduling policy will be provided at booking or in the Client Agreement. If no policy is provided, you may request to reschedule with reasonable notice, and we will try to accommodate based on availability.
9) Acceptable use
You agree not to:
- Use the Site for any unlawful purpose
- Interfere with or disrupt the Site (including attempting to probe, scan, or test vulnerabilities)
- Upload or transmit malicious code, spam, or harmful content
- Scrape, copy, or harvest content or data from the Site at scale without permission
- Misrepresent your identity or affiliation
We may suspend or block access to the Site for violations.
10) Intellectual property
Our content. The Site and all content on it (text, images, graphics, logos, designs, layout, and compilations) are owned by or licensed to Irenity Interiors and are protected by U.S. and international intellectual property laws.
Limited license. We grant you a limited, non-exclusive, non-transferable license to access and view the Site for your personal or internal business use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our prior written consent.
Portfolio use. Unless a Client Agreement states otherwise, you agree we may photograph and/or display completed project work in our portfolio, including on the Site and social media, provided we do not disclose your confidential information. If you require a non-public project, this must be agreed in writing.
11) User submissions
If you submit information through forms, email, or other channels (including project details, photos, measurements, inspiration images, and messages), you:
- Represent you have the rights to share it
- Grant us a license to use it to evaluate your inquiry and provide or propose services
- Understand we are not responsible for maintaining copies of your submissions
Confidentiality, if needed, should be handled in a written NDA or Client Agreement.
12) Third-party links and services
The Site may link to third-party websites or services (e.g., social platforms, scheduling providers). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
13) Disclaimers
Site provided “as is.” The Site is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, error-free, or that content is complete, accurate, or current.
14) Professional services disclaimer (important)
Interior design recommendations can involve construction, code compliance, permitting, structural conditions, engineering, and trade work. Unless explicitly stated in a Client Agreement, we are not acting as a licensed architect or engineer and do not provide legal, structural, or code compliance guarantees. You are responsible for:
- Verifying measurements and site conditions
- Hiring appropriately licensed professionals (contractors, electricians, plumbers, engineers, architects)
- Obtaining permits and complying with local laws and HOA/building rules
15) Limitation of liability
To the maximum extent permitted by law, Irenity Interiors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Site.
To the maximum extent permitted by law, our total liability for any claim related to the Site will not exceed USD $100 (or, if you paid us for a paid consultation through the Site within the prior 12 months, the amount you paid for that consultation).
Some states do not allow certain limitations, so parts of this section may not apply to you.
16) Indemnification
You agree to defend, indemnify, and hold harmless Irenity Interiors from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or your misuse of the Site.
17) Privacy
Your use of the Site is also subject to our Privacy Policy.
18) Governing law and venue
These Terms are governed by the laws of the State of [INSERT STATE], without regard to conflict-of-law rules. Any dispute not subject to arbitration (if you adopt Section 19) will be brought in the state or federal courts located in [INSERT COUNTY/STATE], and you consent to personal jurisdiction there.
19) Optional: arbitration and class action waiver (USA)
If you want an arbitration clause (common for U.S. sites), insert your preferred structure here (provider, location, opt-out window). Arbitration language should be reviewed by a U.S. attorney to match your state and business setup.
20) Termination
We may terminate or suspend access to the Site immediately if we reasonably believe you have violated these Terms or used the Site unlawfully.
21) Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Irenity Interiors regarding the Site (not Design Services, which are covered by the Client Agreement if you hire us).
